DayDreymer (DayDreymer.com) means the product supplier, This e-mail address is being protected from spambots, you need JavaScript enabled to view it . Customer means the entity/person that rents products from DayDreymer. Service means the products package (shopping cart) rented out and distributed by DayDreymer. The agreement is between DayDreymer and the Customer (whose name is stated during ordering at the DayDreymer webshop). The rental term for the services is specified per show.

General

a.) The Customer agrees that email can be used as a long-distance means of communication.

b.) No contract for the sale of any product will subsist between the Customer and DayDreymer unless and until DayDreymer accepts your order by way of an e-mail confirming that it has received payment in full for all the services you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time DayDreymer sends the e-mail to you (whether or not you receive that e-mail). This confirmation e-mail amounts to an acceptance by DayDreymer of your offer to buy the service from DayDreymer or a 3rd party supplier that is engaged on your behalf by DayDreymer.

c.) This confirmatory e-mail will contain all relevant statutory information concerning your contract.

d.) The confirmatory e-mail will also contain a link to these terms and conditions, and may be amended in accordance with paragraph dd. below.

e.) You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.

f.) DayDreymer will not pass on your details to any third party.

g.) Customer undertakes that all details provided to DayDreymer for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

h.) If there are any changes to the details supplied by customer it is the customers responsibility to inform DayDreymer as soon as possible.

i.) DayDreymer has the right to refuse submitted contracts without stating any reason for its decision.

Service

j.) DayDreymer shall provide the Customer with the service and shall install it on DayDreymer’s server(s).

k.) DayDreymer reserves the right to amend the Service specifications without notice.

l.) The Customer shall keep in his/her possession all data that he/she gathers during the contract period and shall not disclose it to third parties.

m.) The Customer is responsible for managing the package that he/she has rented.

Processing of orders

n.) The Customer shall pay all costs arising under the contract through its use of the Service.

o.) Credit and Debit cards are debited before your service is delivered. All prices include sales taxes (where applicable) unless otherwise stated.

p.) Every purchase you make shall be deemed performed in Kuala Lumpur, Malaysia. Malaysian law shall govern every aspect of contractual agreement concerning purchases made.

q.) The Customer shall not transfer this contract or any rights or obligations there in to any third party without the explicit written permission of DayDreymer.

r.) The Customer shall not sub-rent to any third party any part of the provided products without the explicit written permission of DayDreymer.

Restrictions

s.) The Customer shall not use the Service or cause it to be used for publication of any information (including images and sounds) that is unlawful or offensive, or infringes the intellectual property rights of third parties, or is confidential, or violates any applicable laws.

t.) The Customer shall indemnify DayDreymer against all and any liability arising from the use of the Service.

Termination

u.) The Customer has the legal right to cancel the order within 7 days as long as the product hasn't been delivered yet. After those 7 days the cancellation fee will be 30% of the order amount. In case the order is cancelled 10 days or less prior to an event where the products or services will be used the cancellation fee will be 70%.

v.) DayDreymer has the right to end the agreement unilaterally if the Customer
a) fails to pay a bill
b) fails to observe the contractual conditions or
c) becomes insolvent.

Liability

w.) DayDreymer shall not accept any liability for damage, data loss or theft (whether direct or indirect) caused by any fault or shortcoming on its part, including but not confined to
a) problems occurring during the transmission of information sent or received by the Customer via the Service or
b) the accuracy of any data or information published by means of the Service.

x.) The total liability of DayDreymer with respect to the Service, for any incident or series of incidents in the rental term, regardless of whether related, shall not exceed the total rent due for the period in which the damage occurred.

y.) The Customer shall have full liability in the event of damage to and/or loss of the Service.

z.) The Customer shall compensate DayDreymer for all damage, legal proceedings, measures, costs, claims and losses caused by failure of the Customer to fulfil obligations under the agreement.

Malaysian Data Protection Act

aa.) The Customer is aware that after receipt of the data he will be considered as the party responsible for processing this data, as referred to in the Malaysian Data Protection Act.

bb.) The Customer indemnifies DayDreymer against possible claims for not complying with the Malaysian Privacy Act.

Miscellaneous

cc.) To the extent that any of the above conditions are invalid or null and void, the rest of the agreement shall survive. In the event of disputed conditions, parties shall exercise their best efforts to agree alternative wordings as close as possible to the original intention of parties.

dd.) DayDreymer may amend these terms and conditions from time to time, and place the new version on the website and such modifications shall be effective immediately upon posting of such changes. Customers are therefore responsible for regularly reviewing these Terms and Conditions or notices posted on the DayDreymer web site. All purchases/rentals from the date that the amended terms are placed on our website onwards will be governed by those new terms.

ee.) Malaysian law shall govern the agreement.
